Point of clarification: During the webinar a question arose as to whether a stand alone 16-19 Academy is required to include one panel member who is independent of the management and running of the institution on a complaints panel at the final stage. The response was that it was necessary. The response should have explained that whilst the Education (Independent School Standards) Regulations 2014 apply generally to academies as “independent schools”, 16 to 19 academies are defined by law as educational institutions principally concerned with the education of young people above compulsory school age and below 19 so are not schools for these purposes. On that basis, there is no requirement to include an independent member of a panel in such circumstances.
